Terms and Conditions for Dath Car Rentals

These Terms and Conditions (“Agreement”) outline the rules for using Dath Car Rentals’ website and services (“Company,” “we,” “us,” or “our”). By accessing our website or renting a vehicle, you (“Customer,” “you,” or “your”) agree to follow these terms. Please review them carefully before making a reservation.

1. Rental Terms

By reserving a vehicle, you agree to this Agreement, which governs all rentals provided by Dath Car Rentals.

• Eligibility: You must be at least 18 years old (or meet the legal age requirement in your area), hold a valid driver’s license, and provide a credit card in your name.

• Driver’s License: A valid license is required at pickup. International renters may need an international driving permit.

• Authorized Drivers: Only individuals listed on the rental agreement may drive the vehicle. Additional drivers may be added for a fee.

2. Reservations, Payments, and Cancellations

• Reservations: Bookings must be made through our website or customer service team and are only confirmed once you receive a confirmation email.

• Payment: Full payment is required at the time of booking. We accept major credit cards, debit cards, and other approved methods.

• Cancellations & Refunds:

  • Cancellations made within [X hours/days] of the start time may incur a fee.

  • Late cancellations may not qualify for a refund.

  • Approved refunds are issued to the original payment method according to our policy.

3. Rental Duration and Returns

• Rental Period: Begins and ends as stated in your agreement.

• Late Returns: Additional charges apply for late returns.

• Early Returns: No refunds are provided for unused rental time.

4. Vehicle Use

• Usage Restrictions: You agree not to:

  • Drive under the influence of drugs or alcohol

  • Use the vehicle off-road or on unapproved surfaces

  • Allow unauthorized drivers to operate the vehicle

  • Use the vehicle for illegal activities or traffic violations

• Mileage Limits: Rentals may include mileage caps. Exceeding these limits may result in extra charges.

• Fuel Policy: Vehicles are provided with a full tank and must be returned full. Otherwise, fuel and service fees will apply.

5. Insurance and Responsibility

• Insurance Options: Coverage may be included or available for purchase. Additional protection is recommended.

• Damage Responsibility: You are responsible for reporting and covering any damage, theft, or accidents during the rental period.

• Liability: You are liable for damages to the vehicle, property, or individuals resulting from misuse or violation of this Agreement.

• Third-Party Coverage: Personal insurance or credit cards may provide rental coverage; it is your responsibility to confirm.

6. Vehicle Return Conditions

• Return Location: Vehicles must be returned to the agreed location unless otherwise approved. Additional fees may apply for alternate returns.

• Condition: The vehicle must be returned in the same condition, excluding normal wear. Excessive dirt or damage may result in cleaning or repair fees.

• Inspection: A representative will inspect the vehicle upon return, and any issues may lead to additional charges.

7. Privacy

Your personal information is handled in accordance with our Privacy Policy. By agreeing to these terms, you confirm that you understand how your data is collected and used.

8. Indemnification

You agree to defend and hold harmless Dath Car Rentals, its employees, and affiliates from any claims, damages, or expenses (including legal fees) resulting from:

• Your use of the rental vehicle

• Violations of this Agreement or applicable laws

• Damage to property or injury caused during your rental period

9. Governing Law and Disputes

• Governing Law: These terms are governed by the laws of the state of CA.

• Dispute Resolution: Disputes will be resolved through binding arbitration in CA. If arbitration is not enforceable, disputes will be handled in a court of proper jurisdiction in that location.

10. Limitation of Liability

To the fullest extent permitted by law, Dath Car Rentals is not responsible for:

• Indirect, incidental, or consequential damages

• Loss of use, income, or profits

• Claims arising from accidents or third-party damages during your rental

11. Changes to Terms

We may update these Terms and Conditions at any time. Updated versions will be posted on our website with a revised effective date. Continued use of our services means you accept any changes.
